Offshore Partner Visa
(subclass 309 and 100)

The Partner (subclass 309/100) Visa is an offshore application, allowing the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia. As this is an offshore application, to apply for this visa, you must currently be outside of Australia.

To be eligible for an Offshore Partner Visa (subclass 309 and 100), you will need to either be married to your partner or be able to show that you have lived together as de facto partners, usually for no less than 12 months, prior to submitting the application (unless an exemption applies).

To apply for an offshore Partner visa, you will need extensive evidence of many aspects of your relationship, including joint financial circumstances, social ties, your shared household and commitment to each other. This evidence must show the level of mutual commitment that you and your partner have to one another, and must prove that you are in a genuine and continuing relationship, you live together (or live separately on a temporary basis only) and are not related by family.

You and your sponsor must also meet health and character requirements, and a number of additional considerations.

An offshore Partner visa application is comprised of two parts: first, the subclass 309 temporary Partner visa. Then, usually two years after the application was initially lodged, you can be considered for Australian permanent residency through the subclass 100 permanent Partner Visa.

In order to apply for a Partner (subclass 309/100) Visa, you must be in a genuine and continuing relationship with your de facto partner/spouse. You will submit the main application component, and your partner completes a sponsorship application linked to your application
